CSDA-Supported Alternative Contracting Measures Clear Second House Policy Committees

Three public works bills improving special district contracting options are making their way through the State Legislature, passing out their respective second-house policy committees this week. The legislation expands or extends the ability of special districts to employ design-build and progressive design-build on public works projects benefiting the communities they serve.

AB 400 (Rubio, B) Design-Build

Extends the sunset date for specified local agencies to use design-build found in Public Contract Code Sections 22160-22169, from January 1, 2025, to January 1, 2031.

SB 706 (Caballero) Progressive Design-Build

Authorizes all cities, counties, city and counties, or special districts to use the progressive design-build process for other projects, in addition to water-related projects, excluding projects on state-owned or -operated facilities. The bill would extend these provisions until January 1, 2030. The bill would change the required reporting date to no later than December 31, 2028.

SB 617 (Newman) Transit Progressive Design-Build

Authorizes transit agencies, as specified, and regional transportation planning agencies (RTPA)s, as specified, to utilize progressive design-build procurement method, through January 1, 2029.

CSDA is actively supporting all three measures. The bills will now head to fiscal committees for further consideration.
