Two-Year Email Retention Mandate Passes First Committee

Last week, Assembly Bill 2093 authored by Assembly Member Todd Gloria (D-San Diego) passed the Assembly Judiciary Committee on a vote of 10-1. This legislation would mandate all public agencies to retain all email, sent and received, for two years. Despite heavy opposition from public agencies, including over 130 letters of opposition submitted from special districts, the bill was passed without any amendments to be heard next in the Assembly Appropriations Committee before May 15.

During the hearing, several of the Judiciary Committee members expressed concerns that the two-year time period may be too long. One such member to express that concern before voting in favor of AB 2093 was Assembly Member Lorena Gonzalez, who chairs the Assembly Appropriations Committee. These comments may portend further discussions around the retention period as the bill moves to the Appropriations Committee for consideration.

CSDA would like to thank all the special districts that have already submitted letters of opposition already. While the vote in Assembly Judiciary Committee may not reflect the level of opposition received, know that it is having an impact. The fact that there were expressions of concern on the bill’s costs to public agencies by committee members is an improvement on the dialogue that occurred last year within the same committee. If your district has not submitted a letter of opposition, we highly encourage you to do so to assist CSDA and other public agencies in stopping this costly bill.
