Email Retention Legislation To Be Heard Tomorrow

Tomorrow, AB 2093 by Assembly Member Todd Gloria (D-San Diego) is scheduled to be heard in the Assembly Judiciary Committee. This is the bill that will require all public agencies, regardless of size and financial resources, to retain all emails related to the public’s business for two-years. The author’s office has indicated that they intend for "public's business" to include out-of-office emails and emails as insignificant as “there is birthday cake in the breakroom.” While there are costs associated with storing all of the additional emails for most agencies, the most significant costs are associated with the review of the two-years’ worth of emails when responding to Public Records Act requests. AB 2093 has received opposition from almost every public agency association and received over 100 letters of opposition from special district.

In addition to sharing the enormous costs this bill will place on public agencies, including the state, CSDA will be highlighting for the Committee how this legislation is modeled after the failing Public Records Act policies of the City of San Diego and that it is unwise to implement a failing policy statewide.
