Fixes to Sexual Harassment Training Requirements Headed to Governor

Yesterday, the California State Assembly unanimously passed
SB 778 (Senate labor and Public Employment Committee)
. The bill will make changes to the newly enacted sexual harassment prevention training requirements for employers that were in
SB 1343 (Mitchell, 2018)
. SB 1343 is the bill that requires all employers with 5 or more employees to provide sexual harassment prevention training to all their employees, two hours for supervisors and one hour for non-supervisory employees, every two years. Unfortunately, the way the bill was drafted, employers that were already providing the training, and did so in 2018, would also be required to provide that training in 2019 rather than on an every two years schedule in 2020. SB 778 clarifies and retains the standard two-year harassment prevention training time-frame moving forward, and also provides additional time for employers to comply with the new training requirements by delaying the implementation date of SB 1343 by one year. If signed by the Governor, SB 778 will take effect immediately and require employers with five or more employees to provide two hours of sexual harassment prevention training for supervisors and one hour of training for non-supervisory employees by January 1, 2021.
