Background

During times of crisis or emergency, it is essential that public agencies are able to continue to provide critical services to the public. To assist in those efforts, CSDA sponsored Assembly Bill 361 (Rivas), which allows public agencies to meet remotely as they did under the Governor’s Executive Orders related to COVID-19.

CSDA has drafted an implementation guide explaining the provisions of AB 361 to assist its members in preparing to rely on its provisions — a necessary step for those agencies wishing to continue meeting remotely without being required to follow the more onerous, usual requirements. This guide and the sample resolutions contained therein have been written with input from the stakeholders directly involved in crafting this legislation.

 AB 361 will sunset by its own provisions on January 1, 2024. Without subsequent action by CSDA and other stakeholders, this authority to conduct remote meetings under modified open meeting procedures during emergencies will terminate on that date.

 AB 361 extends similar authority to certain types of state agencies for a period ending early next year on January 31, 2022.
