AG Releases Opinion on Closed Sessions

The California Attorney General (AG) recently released an official opinion further defining when the Brown Act permits discussion of real-estate negotiations within a closed session. Specifically, the AG explained that the real-estate negotiation exception to open meeting laws allows for discussion of:

  • The amount of consideration that the local agency is willing to pay or accept in exchange for real property rights to be acquired or transferred.
  • The form, manner, and timing of how that consideration will be paid.
  • Items that are essential to arriving at the authorized price and payment terms.
