On September 9, 2022, EPA released its 60-day Notice of Proposed Rulemaking designating the two most studied and most widely used PFAS – perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS) – as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act, commonly referred to as the “Superfund Law,” which is an EPA program to respond to environmental contamination to protect public health as well as the environment. Comments are due November 7, 2022. 

Prominent organizations following this policy issue estimate the costs of this cleanup could total at least $400 billion. Special districts who provide water, wastewater, and fire protection services could be the most impacted by the rulemaking and other federal action on PFAS.
