On August 17, CSDA and its coalition partners submitted comments on Cal/OSHA’s revised Title 8 Section 3343, Workplace Violence Draft Regulation for General Industry. The draft regulation is currently in the advisory committee pre-rulemaking phase.

Cal/OSHA’s rulemaking is for the purpose of implementing Senate Bill 553 (Cortese, 2023) pertaining to Workplace Violence Prevention. SB 553 was signed into law September 30, 2023, and became effective July 1, 2024. With limited exceptions, the measure currently requires employers to develop and implement a plan for addressing workplace violence as specified in Labor Code Section 6401.9.

This phase may be the final opportunity, or one of the final opportunities, to influence the draft regulation before it enters formal rulemaking. For more information on CSDA's prior comments on the regulation, please see: CSDA Submits Comment Letter on Proposed Workplace Violence Prevention Regulations.

A copy of CSDA’s most recent comment letter may be viewed here. The letter reiterates comments previously made and not resolved in the current draft.

CSDA’s letter also focuses on:

  1. §3343(a) – Employer-provided transportation
  2. §3343(b)(7) – Texts and social media threats
  3. §3343(b)(9)(A) – Appropriate staffing levels
  4. §3343(b)(10)(G) – Separate terms for frequent contact with the public and uncontrolled public access
  5. §3343(c)(6)(A) – Reporting to designated person
  6. §3343(c)(10) – Addressing workplace hazards “to the extent feasible”
  7. §3343(c)(11)(C) - Trauma counseling
